Greg Raymer dropped some juicy gossip the other day related to Cardplayer Magazine and the legality of the UIEGA. As most online poker players know they are not doing anything illegal but Greg goes a step further stating that the Department of Justice actually sent warnings and came into the offices of Cardplayer to seize documents. Apparently as a bullying tactic. What was the outcome? Absolutely nothing. The DOJ has been successful in some cases where the accuses would rather not stand up and fight. Apparently they picked on the wrong guy when they knocked on Barry Shulman's door. Greg's conclusion (he is a lawyer after all) is that poker is not only legal for players but for advertisers as well. In theory all of the .net ads that you see on television could become .com ads if someone wanted to test those waters. Right now though it seems everyone is pretty content with things as they are. Here is the article Greg did with the National Review, the relevant text is quoted below. "RAYMER: No, but Card Player magazine is a perfect example. They were running ads for real money sites — when you see a TV commercial right now, it’s for sites that only give you access to play money games. Card Player magazine was still running commercials for sites that offered real-money poker games. The Department of Justice was threatening them, sending them letters, that if they didn’t cease and desist, arrests would follow. They then came in with warrants, searched the offices, seized documents, maintained copies of those documents to use in a prosecution. But they never sought an indictment. In my opinion, it’s because the Department of Justice knew that if they actually went to court with Card Player — and the Department of Justice knew they would fight, that they wouldn’t settle out of court — then they would have to live with whatever the judge said."
